These Terms of Service (“Terms”) govern your access to and use of www.yumicart.com and any purchase from YUMICART. By visiting the Site, placing an order, or otherwise using our services, you agree to these Terms and the policies referenced in them.

Nothing in these Terms excludes or limits consumer rights that cannot lawfully be excluded or limited.

1. Eligibility and acceptable use

You must be at least the age of majority in your place of residence and legally capable of entering into a contract to place an order. The complete DIY kit contains epoxy resin and is for adult use only (18+).

You must not misuse the Site, interfere with its security or operation, introduce malicious code, scrape the Site in an unauthorized manner, violate another person’s rights, or use the Services for an unlawful purpose.

2. Shopify

Our store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to offer products and Services to you. Your use of Shopify-powered features may also be subject to Shopify’s applicable terms and privacy practices.

3. Product information

YUMICART sells DIY material kits. Unless a product page expressly states otherwise, finished pendants or keepsakes shown in photographs are examples of what a customer may make and are not included in the purchase.

We make reasonable efforts to describe products accurately. Because screens, production batches, packaging, and handmade results vary, colors, component appearance, and finished results may differ from photographs. Minor bubbles, texture, placement, and finish variations are normal in customer-made resin work and are not guaranteed outcomes.

Kit contents are described on the applicable product page. We may make minor, non-material substitutions of tools, packaging, or decorative components when reasonably necessary, provided the function and overall value are not materially reduced.

4. Resin safety

Read the included instructions and both Safety Data Sheets before opening or using the resin. Use only in a well-ventilated area and wear suitable protective gloves and eye protection. Avoid skin and eye contact. Keep all materials away from children, pets, food, drink, and open flames. Do not ingest. Do not use the kit to make food-contact items, toys, body jewelry, or items intended for medical use.

Safety Data Sheets and transport reports are made available for information about the supplied materials. They do not guarantee a particular handmade result and should not be treated as a substitute for following the product instructions, label, carrier rules, or applicable law.

If exposure or an adverse reaction occurs, stop using the product, follow the Safety Data Sheet, and seek appropriate local medical or poison-control advice.

5. Orders

Your order is an offer to purchase. We may accept, reject, or cancel an order for legitimate reasons, including product unavailability, pricing or description errors, suspected fraud, payment failure, destination restrictions, or inability to ship resin to the address provided.

An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we dispatch the order or otherwise confirm fulfillment. If we cancel a paid order before dispatch, we will refund the affected amount.

You are responsible for providing accurate billing, delivery, and contact information. Purchase quantities may be limited where reasonably necessary.

6. Prices, payments, taxes, and duties

Prices and available currencies are shown on the Site and may change without notice before purchase. You authorize the payment provider to charge the amount shown at checkout.

Taxes collected by YUMICART will be shown at checkout. For international orders, import duties, VAT, brokerage, customs fees, or similar charges may be payable by the recipient unless checkout expressly states that they are included. Please review our Shipping Policy.

7. Shipping and delivery

Orders ship from China. Processing times, estimated delivery windows, tracking, customs information, and destination restrictions are described in our Shipping Policy. Delivery estimates are not guarantees.

8. Returns and refunds

Returns, refunds, damaged items, cancellations, and any applicable statutory withdrawal rights are governed by our Return and Refund Policy.

9. Intellectual property

The Site and its content, including branding, text, graphics, photographs, videos, designs, and software, are owned by or licensed to YUMICART and are protected by applicable intellectual property laws. You may use the Site for personal, non-commercial shopping purposes. No other license is granted.

You may not copy, reproduce, distribute, sell, modify, or commercially exploit Site content without prior written permission, except where the law permits.

10. Reviews and submitted content

If you submit a review, photograph, feedback, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not infringe another person’s rights. You grant YUMICART a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with operating, improving, and promoting the Services, subject to applicable privacy law.

We may remove content that is unlawful, misleading, abusive, infringing, or unrelated to the product or Services.

11. Third-party services and links

The Services may include third-party payment, delivery, analytics, social media, or other services and links. We are not responsible for independent third-party sites or their content, terms, availability, or privacy practices. Your use of a third-party service is at your own discretion and may be governed by that provider’s terms.

12. Disclaimer

To the fullest extent permitted by law, the Site and Services are provided on an “as available” basis. We do not guarantee that the Site will always be uninterrupted, error-free, or completely secure, or that a customer-made resin piece will match an example image.

This disclaimer does not affect legal guarantees, warranties, remedies, or consumer protections that apply to you and cannot be excluded.

13. Limitation of liability

To the fullest extent permitted by law, YUMICART is not liable for indirect, incidental, special, or consequential loss arising from misuse of the product, failure to follow the instructions or Safety Data Sheets, unauthorized alteration, or use for an unintended purpose.

Where liability cannot be excluded, it is limited only to the extent permitted by law. Nothing in these Terms excludes liability for fraud, willful misconduct, death or personal injury caused by negligence where such exclusion is prohibited, or any other liability that cannot lawfully be excluded.

14. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims caused by your unlawful use of the Services, material breach of these Terms, or infringement of another person’s rights. This section does not apply where prohibited by consumer law.

15. Severability and waiver

If part of these Terms is found invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. A delay or failure to enforce a provision is not a waiver of the right to enforce it later.

16. Changes

We may update these Terms by posting a revised version on the Site. Changes apply prospectively from the stated update date. The Terms in effect when you placed an order continue to govern that order unless the law requires otherwise.

17. Applicable law

These Terms are governed by the laws applicable where YUMICART is established, without regard to conflict-of-law principles. If you are a consumer, this choice does not deprive you of mandatory protections or the right to bring a claim in a forum available under the law of your place of residence.
